I won't comment on abortion, but with respect to the situation with Catholic Charities, I think that the right of Catholic Charities to behave in accordance with its own principles (which it seems to be in internal conflict over, but that is something with which we need not concern ourselves here) outweighs the right of gay couples to adopt through Catholic Charities - and though I doubt that Romney even has the legal right to grant a waiver to the law requiring adoption agencies to operate in a non-discriminatory manner (unless the law explicitly grants him that right, and, even then, such a provision might not be Constitutional), I also believe that such a law is unconstitutional. Adoption is not an arms-length transaction. It is pretty well accepted that adoption agencies should exercise discretion in the granting of adoptions and therefore I don't think a law requiring non-discriminatory practices in the operation of private adoption agencies is analogous to a law requiring non-discriminatory practices in the sale or rental of real or personal property or the operation of a public accomodation (such as a store).
